Crohn’s & Colitis Ireland (CCI) warmly welcomes the introduction of the Equal Status (Access to Toilet Facilities) Bill 2026.
The Bill brought forward by Labour’s Mark Wall TD, which seeks to give the No Wait Card long?overdue legal recognition. This is a landmark moment for people living with Crohn’s Disease, Ulcerative Colitis, Ileostomies, and other chronic and invisible illnesses that cause sudden, urgent need for toilet access.
The Bill was introduced in the Dáil in mid?January 2026 and builds on many years of advocacy from patients, clinicians, and organisations - including ourvery own community here at CCI.
What the Bill Proposes
Key provisions outlined in the Bill include:
- Placing the No Wait Card on a statutory footing, meaning shops and businesses with staff toilets must allow access to a person who presents the card and urgently needs to use the bathroom.
- Legal protection for businesses, excluding them from liability under the Occupiers’ Liability Act when providing toilet access to card holders. The legislation also confirms that no modifications or additional costs are required for staff toilets to comply.
- Recognition of the lived reality of chronic illness, positioning the Bill as a compassionate and practical solution that could be life?changing for thousands across Ireland.
